ARTICLE 7. COMMON ELEMENTS

Section 7.1 Title to Common Elements. All Common Elements were dedicated in accordance with the terms of the Map upon recording of the Map. Every Common Element shall be subject to an easement of common use and enjoyment in favor of the Association and every Unit Owner, their heirs, successors, and assigns, in accordance with the terms and conditions of the Governing Documents and the Map.
 
Section 7.2 Maintenance of Common Elements. The Association shall maintain, repair, replace, improve, and otherwise manage all of the Common Elements so as to keep them in good repair and condition and shall conduct such additional maintenance, repair, replacement, construction, or reconstruction as may be determined pursuant to Association Action. The Association shall take any action necessary or appropriate to the maintenance and upkeep of the Common Elements and improvements thereon.
 
Section 7.3 Monument and Landscaping Maintenance and Easements. The Association shall be responsible for maintaining any Lexington Subdivision monument signage and shall be responsible for maintaining any landscaping in Common Elements in accordance with the terms of the Map and all applicable laws, codes and regulations. The Association is also responsible for maintaining the street trees within Lexington Subdivision and the landscaping strips adjacent to Tracts A and I. Notwithstanding the foregoing, the landscaping strips between the sidewalks and public streets are to be maintained by each adjacent Unit Owner.
